Terms of Service

1. Agreement

By accessing or using SyntHire websites, applications, or APIs (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts and early access

You must provide accurate registration information and keep credentials confidential. Recruiter and agency access may require a questionnaire and our approval before the product unlocks. You are responsible for activity under your account.

3. Acceptable use

You will not misuse the Services, including by attempting to access non-public areas, interfere with other users, upload unlawful content, or use the Services to discriminate unlawfully against candidates. You are responsible for compliance with employment and privacy laws in your jurisdiction when collecting or processing candidate data.

4. Customer data

You retain rights to data you submit (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Services. Our processing of personal information is described in the Privacy Policy.

5. Trials, subscriptions, and credits

Approved recruiters may receive a limited free trial (for example five days or a capped number of AI interviews, whichever ends first). After the trial, continued interviewing requires an active subscription and/or purchased credits as described at checkout. Unless stated otherwise, fees are non-refundable. We may change plan prices or included allotments with notice where required.

6. Intellectual property

We own the Services, software, and branding. Except for the rights expressly granted in these Terms, no rights are transferred to you. Feedback you provide may be used by us without obligation to you.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY APPLICABLE LAW. AI-generated outputs may be incorrect; you remain responsible for hiring decisions.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (OR ONE HUNDRED CANADIAN DOLLARS IF NO FEES APPLIED). Nothing in these Terms excludes liability that cannot be limited under Québec or Canadian law.

9. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms or risk to the Services. Provisions that by their nature should survive will survive termination.

10. Governing law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, excluding conflict of law rules. Courts of the district of Montréal, Québec have jurisdiction, subject to mandatory consumer protections where applicable. If you are a consumer in Québec, nothing in these Terms limits rights you cannot waive under public order.

A French version of these Terms may be provided on request. If both language versions exist, the French version prevails for Québec consumers to the extent required by law.

11. Changes

We may modify these Terms by posting an updated version. Material changes may require additional notice where required by law. Continued use after the effective date constitutes acceptance, except where consent is required.
